Practice Description
Civil litigation, in both Federal and Texas State Courts, of contract, fraud and statutory claims. Regular representation of property owners, secured lenders and contractors on matters related to building construction and real property, including, mechanic's liens, lis pendens, sales agreements, easements, title insurance, restrictive covenants, oil and gas interests and zoning.
Recent Representative Matters
- Broad range of collection and real estate enforcement actions.
- Secured complete title to oil and gas interests for international investors.
- Enforcement of a Texas Judgment in South Korea.
- Domestication of a Swedish Judgment in Texas.
- Collected over $200,000,000 in real estate loan collateral, while pursuing creditor's rights in both civil and bankruptcy courts and defending related lender liability claims, primarily in connection with the financial institutions crisis.
- Prosecuted to judgment a general contractor's claims for delay damages and defended against the owner's claim for approximately $5,000,000 in alleged construction defects.
- Invalidated the zoning ordinances of the Town of Westlake, Texas, on due process and equal protection grounds, by judgment entered in 1993.
- Two successful appeals to the United States Court of Appeals for the Fifth Circuit of ERISA issues referred by others.
